These Terms of Service ("Terms") govern your use of the Cura mobile application ("Cura", "the app", "we", "our") developed by an independent developer. By downloading, installing, or using Cura, you agree to these Terms. If you do not agree, please do not use the app.

1. About Cura

Cura is a personal migraine tracking application that helps you log, monitor, and understand your migraine patterns. The app is available as a subscription service through the Apple App Store and Google Play Store.

2. Subscription Terms

Key subscription details

Cura operates on a subscription-only model. A paid subscription is required to access the app's features.
Subscriptions are billed through your Apple App Store or Google Play Store account.
Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
You can manage or cancel your subscription at any time through your device's subscription settings (Settings → Apple ID → Subscriptions on iOS, or Google Play → Subscriptions on Android).
No refunds are issued for partial billing periods. Refund requests must be directed to Apple or Google per their respective policies.
Prices may change with advance notice. Any price increase will not apply until your next renewal after notification.

3. Acceptable Use

You agree to use Cura only for its intended purpose of personal health tracking. You agree not to:

Reverse engineer, decompile, or disassemble the app
Use the app for any unlawful purpose
Attempt to access other users' data or interfere with the service
Redistribute, sublicense, or resell access to the app
Use automated systems to interact with the app

5. Health Disclaimer

Cura is NOT a medical device and does NOT provide medical advice.

The app is designed as a personal tracking tool only. Information provided by Cura (including pattern insights, weather correlations, and trigger suggestions) is for informational purposes and should never replace professional medical judgment.

Always consult a qualified healthcare provider for medical decisions
Do not delay seeking medical attention based on anything in this app
If you are experiencing a medical emergency, call emergency services immediately
We make no claims about the accuracy of pattern detection or trigger correlation

6. Your Data

You own your data. All migraine logs, notes, and personal information you enter into Cura belong to you. We are custodians of your data, not owners. You can:

Export your data at any time using the app's export feature
Delete all your data from within the app's Settings
Request a complete copy of your data by contacting us

7. Intellectual Property

The Cura app, including its design, code, features, and branding, is the intellectual property of its developer. Your subscription grants you a personal, non-transferable, non-exclusive license to use the app. This license does not transfer any ownership rights to you.

8. Service Availability

We strive to keep Cura available and reliable, but we cannot guarantee uninterrupted service. The app may be temporarily unavailable due to:

Maintenance or updates
Server or infrastructure issues beyond our control
Force majeure events

Since Cura uses an offline-first architecture, your data remains accessible on your device even without an internet connection.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

Cura is provided "as is" without warranties of any kind, express or implied
We are not liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim
We are not responsible for decisions made based on data or insights from the app

10. Termination

You may stop using Cura at any time by cancelling your subscription and deleting the app. We may terminate or suspend your access if you violate these Terms. Upon termination:

Your right to use the app ceases
You can still export your data before deletion
We will delete your cloud data within 30 days of account deletion

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where practical, notify you through the app. Continued use of Cura after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation before pursuing formal proceedings.
